Terms of Service
These Terms of Service ("Terms") govern your use of the Corpus 4AR mobile application (the "App"), published by Artem Bulatov, an individual entrepreneur based in Montenegro ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
Corpus 4AR is not a medical device. It is an educational and reference tool. It is not intended for diagnosis, treatment, monitoring, or any clinical decision-making. Do not rely on it for clinical care.
1. License to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal, non-commercial use or for the internal educational and reference use of your professional practice. You may not reverse-engineer, decompile, disassemble, sublicense, rent, lease, or redistribute the App, except to the extent those restrictions are prohibited by applicable law.
2. Not a medical device
Corpus 4AR is not a medical device as defined under the United States Federal Food, Drug, and Cosmetic Act (21 CFR Part 820 and related provisions), the European Union Medical Device Regulation 2017/745 (MDR), the UK Medical Devices Regulations 2002, or equivalent regulations in other jurisdictions. It has not been evaluated, cleared, approved, registered, or certified by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), any EU notified body, the UK Medicines and Healthcare products Regulatory Agency (MHRA), or any other regulatory authority.
3. Not for clinical use
The App is intended for anatomical education, reference, and demonstration only. It is not intended for use in clinical, diagnostic, therapeutic, interventional, surgical, emergency, or forensic contexts. It must not be used to:
- diagnose or rule out any disease, injury, or condition;
- plan, guide, or perform any medical, surgical, dental, or interventional procedure;
- monitor a patient's condition;
- calculate dosages, select treatments, or make any clinical decision;
- substitute for examination, consultation, or advice by a qualified healthcare professional.
If you are a clinician, you remain solely responsible for all clinical decisions. If you are a patient or caregiver, always consult a qualified healthcare professional for any medical concern.
4. Approximation disclaimer
Anatomical structures shown in the App are rendered from a single standardized reference model (the BodyParts3D library, © DBCLS, Japan) and positioned on the tracked body using estimates produced by Apple's ARKit framework. These positions are approximate. Actual anatomy varies between individuals and with pose, respiration, body composition, prior surgery, congenital variation, and other factors. The overlay may also shift with lighting, camera distance, clothing, and the quality of the body-tracking signal. The App does not represent, and must not be taken to represent, the actual anatomy of any specific person.
5. No diagnosis, treatment, or professional advice
Nothing displayed, described, or implied by the App constitutes medical, diagnostic, therapeutic, legal, or other professional advice. No doctor-patient or other professional relationship is created by your use of the App. You must not use anything shown in the App as a basis for self-diagnosis, self-treatment, or any medical decision.
6. Privacy
The App processes data on your device and transmits nothing to our servers. See the Privacy Policy for details. The Privacy Policy is incorporated into these Terms by reference.
7. User content and recordings
The App can produce photos and video clips of the AR overlay. Any such content is saved only at your request, to your own Photos library or through the iOS share sheet. You are solely responsible for the content you capture and share, including obtaining any consent required from individuals depicted and complying with applicable privacy, data protection, and right-of-publicity laws.
8. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT ITS OUTPUTS WILL BE ACCURATE, OR THAT ANY DEFECTS WILL BE CORRECTED. Your use of the App is at your sole risk. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the above exclusions apply to the maximum extent permitted by law.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (b) FIFTY EUROS (€50).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by gross negligence or wilful misconduct, or for fraudulent misrepresentation.
10. Indemnification
You agree to indemnify, defend, and hold harmless Artem Bulatov and any affiliates, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party, including rights of publicity, privacy, or data protection; and (d) any clinical, diagnostic, or treatment decision you make in reliance on the App in breach of Sections 2 through 5.
11. Third-party content
The App renders 3D meshes derived from the BodyParts3D library, © The Database Center for Life Science (DBCLS), Japan, licensed under the Creative Commons Attribution-Share Alike 2.1 Japan license (CC BY-SA 2.1 JP). The App uses Apple ARKit and RealityKit under the standard Apple SDK terms. These third parties are not responsible for the App.
12. App Store terms
The App is distributed through the Apple App Store. Your use of the App is also subject to the Apple Media Services Terms and Conditions. Apple is not a party to these Terms, but is a third-party beneficiary of these Terms and is entitled to enforce them against you.
13. Changes to the Terms
We may update these Terms from time to time. The updated Terms take effect on the "Effective date" shown above. Material changes will be noted in the App Store release notes. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
14. Termination
You may stop using the App at any time by deleting it from your device. We may suspend or discontinue the App, in whole or in part, at any time and without notice. Sections that by their nature should survive termination will survive, including Sections 2 through 5 and 8 through 15.
15. Governing law and venue
These Terms are governed by the laws of Montenegro, without regard to its conflict-of-laws rules. You and we agree that the courts of Podgorica, Montenegro have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or the App, except that nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction. Mandatory consumer-protection rights granted to you by the laws of your country of residence are not affected by this clause.
